Dituding Manipulasi Zonasi Pada PPDB, Kepala Sekolah SMA Negeri 1 Cibinong Somasi Media

Bogor, (BERITASATOE COM) –  Merasa tidak terima diberitakan terkait dugaan manipulasi sistem Zonasi pada PPDB tahun 2021, Kepala Sekolah SMA Negeri 1 Cibinong Melalui surat nomor : 488/LS/IX/2021 Law Office Lava Sembada & Associates yang beralamat di jalan Pandega No. 35 Kedung Halang Bogor,  selaku kuasa hukumnya Dra. Hj.Eli Supartini (Kepala Sekolah SMA Negeri 1 Cibinong-red) menyampaikan hak jawab dan somasi kepada pimpinan redaksi Media MetroIndonesia.id tertanggal 10 September 2021 dan surat telah di terima tanggal 15 September 2021.

Surat somasi yang di terima redaksi media metroindonesia.id tertanggal 26 Juli 2021 menyatakan bahwa, dasar somasinya adalah terkait pemberitaan di media tersebut dengan judul ” Dugaan Manipulasi Zonasi di SMAN 1 Cibinong Semakin Kuat”  adalah berita yang tidak memiliki kebenaran dan fakta fakta sesungguhnya.

Dalam somasi itu pula dengan tegas meminta pihak redaksi untuk bmeminta maaf secara terbuka sekaligus mencabut dan/atau meralat artikel berita baik di media online maupun cetak.dengan headline tersebut yang menyesatkan dalam jangka waktu 3 X 24 jam sejak tertanggal surat ini.

Lebih lanjut kuasa hukum Eli Supartini menyampaikan akan membuat laporan polisi berdasarkan pasal 27 ayat (3) UU nomor 11 tahun 2008 ITE dan pasal 310 311 KUHP.

Menanggapi hak jawab dan somasi tersebut, pihak redaksi media metroindonesia.id pada konpres, 18 September 2021 di warung Papatong Pemda Kab. Bogor redaksi Metro Indonesia di dampingi Kepala Biro Bogor Raya Richard Purba dan rekan media Mata Bind menyampaikan kepada rekan rekan media sbb :

1. Jika pemberitaan tidak benar kenapa pada penyampaian hak jawab ke Pimpinan Redaksi tidak menerima penjelasan yang sebenarnya seperti apa ?

2. Untuk meminta maaf 3 X 24 Jam secara terbuka, dalam surat somasi tidak menjelaskan kepada siapa harus minta maaf ? Dalam berita tidak menyebutkan nama tapi badan publik SMAN 1 Cibinong,

3. Dalam surat kuasa khusus ada kalimat ” untuk dan atas nama pemberi kuasa , mendampingi dan memberikan bantuan hukum kepada pemberi pemberi kuasa guna memberikan hak jawab ” saya rasa itu sudah terlambat.

Surat permohonan informasi publik metroindonesia.id sesuai kode etik jurnalistik pasal 3 tertanggal 25 Juli 2021 dan telah di terima tgl 26 Juli 2021, sesuai undang undang nomor 14 tahun 2008 SMAN 1 Cibinong selaku badan publik mempunyai kewajiban memberikan informasi 10 hari setelah permohonan di terima, kenapa baru sekarang hak jawab di sampaikan, dan tidak sesuai dengan yang dimohonkan.

3. Terkait ancaman akan melaporkan kepolisian pasal 27 ayat (3) ” Pasal 27 ayat 3 UU ITE menyebut melarang setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan penghinaan dan/atau pencemaran nama baik.”

Mengapa tidak menjelaskan kalimat mana dalam berita yang merasa terhina dan jelaskan pencemaran seperti apa yang di tuduhkan.

Dalam surat somasi kenapa tidak menjelaskan siapa seseorang yang di maksud, apakah namanya ada dalam artikel pemberitaan.

Jadi kepada rekan rekan media silahkan menilai, untuk fakta – fakta yang dikatakan menyesatkan sudah saya sampaikan kepada yang berkompeten.

Untuk siswa yang diterima menggunakan rekomedasi anggota dewan provinsi Jawa Barat tidak benar, mengapa tiba tiba yang bersangkutan memblokir nomor kontak wartawan Metro Indonesia

Dan silahkan rekan rekan wartawan klo mau konfirmasi ke SMAN 1 Cibinong, penggunaan jasa lawyer apa sudah seijin atasan atau pribadi, jika sudah seijin atasan juga tanya anggaran yang akan digunakan untuk sukses fee darimana ?

Menanggapi viral nya somasi lawyer di rekan rekan media, Pengawas Dewan organisasi Pers  AWPI Kota Bogor Hardadi Sulaksmono turut menyampaikan  ” bahwa “Ada kecenderungan dari para pihak yang diminta penjelasan, konfirmasi, klarifikasi untuk membuka data oleh pihak media, terkesan apriori, menutupi bahkan menghalangi tugas para awak media dalam mendapatkan informasi yang sejelas-jelasnya pra penayangan pemberitaan., entah apa yang ditutupi ? Padahal para Jurnalis tersebut meminta kejelasan berdasarkan UU.PERS No.40 thn 1999, dimana para pihak yang menghalangi tugas para Jurnalis dalam memperoleh informasi valid.., terancam dengan ancaman pidana.”.
