Hakim Pengadilan Tipikor Tolak Eksepsi Ade Yasin, Ini Alasannya

BANDUNG, (BS) – Sidang keempat perkara kasus suap oknum Pejabat BPK Perwakilan Jawa Barat dengan terdakwa Bupati Bogor Nonaktif Ade Yasin digelar secara Virtual di Pengadilan Tipikor Pengadilan Negeri Klas 1A Bandung hari ini, Senin 1 Agustus 2022.

Dalam Sidang yang dipimpin Hakim Ketua Hakim Hera Kartiningsih itu  secara tegas menolak eksepsi dari kuasa hukum terdakwa dengan alasan tuntutan atau dakwaan Jaksa Penuntut Umum (JPU) sudah jelas, lengkap dan cermat.

Selain itu menurut Hakim, perbuatan yang telah dilakukan terdakwa bukanlah pengulangan pidana dan yang sudah mendapat keputusan hakim dan perkara tersebut bukan perkara yang sudah lewat atau kadaluarsa.

“Sehingga eksepsi atau keberatan kuasa hukum terdakwa agar dakwaan JPU KPK tidak diterima oleh Hakim dinyatakan tidak dapat diterima,” tegasnya.

“Menimbang bahwa eksepsi dari Penasehat Hukum tidak dapat diterima, maka pemeriksaan terhadap terdakwa Ade Yasin dapat dilanjutkan oleh JPU KPK.” tambah Ketua Majelis Hakim itu.

Dengan demikian majelis hakim menyatakan pemeriksaan terhadap terdakwa Ade Yasin dilanjutkan dengan mempergunakan surat dakwaan Penuntut Umum, dengan nomor nomor perkara 65/TUT.01.04/24/07/2022 tertanggal 6 Juli 2022 sebagai dasar pemeriksaan perkara ini sehubungan dengan putusan sela ini hingga putusan akhir, tandasnya.

Sementara itu Roni Yusuf, Jaksa Penuntut Umum (JPU) KPK menyatakan siap untuk melanjutkan tuntutan dengan alasan dakwaan jaksa sudah jelas, lengkap dan cermat.

“Jaksa dalam hal ini siap melanjutkan tuntutan, alasannya semua dakwaan jaksa sudah jelas, lengkap dan cermat,” tegasnya.

Masih ditempat yang sama, salah satu penasehat hukum Ade Yasin yakni Dinalara Dermawanti Butar Butar mengatakan menghargai keputusan hakim pada Sidang Putusan Sela tersebut.

” Kami sangat menghargai keputusan majelis hakim yang menolak eksepsi kami hari ini, karena putusan sela ini kan bukan akhir dari segalanya. Ini hanya untuk memperlancar sidang berikutnya,” ujar Dinalara.

“Bahwa pada sidang selanjutnya, Rabu 3 Agustus 2022 mendatang akan dihadirkan Saksi-saksi. Nah nanti kita akan coba membuktikan pernyataan-pernyataan yang menyudutkan klien kami oleh orang tertentu. Diperiksakan saksi nanti kami yakin akan terbongkar semuanya, akan terlihat kebenaran itu,’ ungkapnya.
