JAKARTA, (BS) – Jaksa Agung Muda Tindak Pidana Umum (JAM-Pidum) Dr. Fadil Zumhana menyampaikan bahwa pada Rabu 05 Oktober 2022 ini, Jaksa Penuntut Umum menerima tanggung jawab Tersangka dan barang bukti (Tahap II) atas nama Tersangka FS, Tersangka REPL, Tersangka RRW, Tersangka KM, dan Tersangka CP (primer Pasal 340 KUHP tentang Pembunuhan Berencana)
Selain itu juga Kejaksaan Agung Juga menerima tanggung jawab Tersangka dan barang bukti para tersangka tindak pidana Obstruction Of Justice dengan Tersangka FS, Tersangka BW, Tersangka PC, Tersangka ARA, Tersangka HK, Tersangka AN, dan Tersangka IW.
“Pada hari ini, penyerahan Tersangka dan barang bukti sesuai dengan ketentuan hukum acara pidana dan kami akan menindaklanjuti dengan mengambil langkah sesuai dengan kewenangan yang diatur dalam Undang-undang bahwa Jaksa Penuntut Umum sesuai ketentuan hukum acara pidana berwenang melakukan penahanan terhadap Tersangka yang diserahkan kepada kami,” ujar Fadil.
Adapun tujuan penahanan sebagaimana dijelaskan bahwa untuk memudahkan proses persidangan karena menginginkan perkara ini dilaksanakan dalam persidangan secara cepat, sederhana, dan biaya ringan, dan memudahkan untuk membawa Tersangka ke persidangan.
Sesuai hasil koordinasi dengan Bareskrim Polri, Tersangka FS, Tersangka HK, Tersangka ARA, dan Tersangka AN dilakukan penahanan di Markas Komando Korps Brigade Mobil (Mako Brimob). Sementara terhadap yang lain yaitu Tersangka CP, Tersangka BW, Tersangka IW, Tersangka RRW. Tersangka REPL, dan Tersangka KM dilakukan penahanan di Bareskrim Polri. Sedangkan untuk Tersangka PC dilakukan penahanan di Rumah Tahanan Negara (Rutan) Salemba Cabang Kejaksaan Agung.
“Pada kesempatan ini, kami pastikan akan sesegera mungkin perkara ini dilimpahkan ke pengadilan, karena kami ingin perkara ini segera mendapatkan keadilan dan kepastian hukum sehingga tidak menunda-nunda waktu pelaksanaan pelimpahan ke pengadilan dan saya pastikan akan sesegera mungkin karena surat dakwaan sudah kami koreksi dan kami terus perbaiki serta sempurnakan supaya dalam persidangan berjalan dengan sebaik-baiknya,” papar Fadil.
Selanjutnya, JAM-Pidum menyampaikan bahwa dalam perkara ini, Presiden RI Joko Widodo meminta kita transparan karena ini perkara yang menarik perhatian masyarakat. Untuk itu, dalam pelimpahan perkara, JAM-Pidum meminta untuk dipantau oleh Komisi Pemberantasan Korupsi (KPK) karena ini juga menjadi perhatian pemerintah.
“Kami di sini yaitu Jaksa Agung Muda Bidang Intelijen (JAM INTELIJEN), Jaksa Agung Muda Bidang Pengawasan (JAM PENGAWASAN), dan Satgas 53, kami libatkan dalam pengawasan setiap penanganan perkara yang kami anggap penting dan menjadi perhatian pimpinan. Jadi pengawasan sangat ketat yang saya minta seluruhnya untuk menjaga keamanan dan ketertiban persidangan agar perkara ini cepat selesai dan energi pemerintah tidak terkuras karena perkara ini. Kita segera selesaikan perkara ini,” jelas Fadil pula.
Terkait dengan rumah aman (safe house), JAM-Pidum menyampaikan bahwa hal tersebut merupakan ide baik dan tentunya kami sangat menghargai. Meski demikian, JAM PIDUM telah memiliki sistem untuk mengamankan para Jaksa agar tidak terintervensi.
“Kami jaga integritas dan profesionalisme Jaksa karena negara ini negara hukum. Saat ini kami pastikan Kejaksaan Agung tidak dapat diintervensi karena kami harus jaga netralitas dalam proses penanganan perkara, dan saya yakin seluruh masyarakat Indonesia, termasuk media dapat mengawasinya. Di dunia digital saat ini, sudah tidak ada yang dapat kita tutup-tutupi dan teman-teman media dapat mengawal supaya perkara berjalan dengan sebaik-baiknya dan seadil-adilnya,” tegas JAM-Pidum.
Fadil mengatakan bahwa para Tersangka akan diberikan keputusan oleh hakim yang seadil-adilnya, dan JAM-Pidum selaku penegak hukum selalu berpegang teguh dalam proses memberikan keadilan dan harus mengacu pada alat bukti, bukan asumsi dan isu-isu yang berkembang di masyarakat. JAM-Pidum berpesan kepada para Jaksa agar pikiran jangan terganggu oleh hal-hal di luar penegakan hukum.
Selanjutnya, JAM-Pidum menyampaikan bahwa sebagai penegak hukum dan Jaksa, memberikan perlakuan yang sama kepada seluruh Tersangka termasuk Tersangka REPL yang berstatus sebagai Justice Collaborator.
“Nanti pengadilan yang melihat bagaimana Tersangka REPL dalam hal selaku justice collaborator. Tidak ada perlakuan yang berbeda dengan status Tersangka ini. Apabila kami limpahkan ke pengadilan, kami akan perlakukan dengan sebaik-baiknya sesuai dengan ketentuan hukum acara pidana dan seluruh proses ini sudah berjalan sesuai SOP penanganan perkara yang kami pegang teguh di JAM PIDUM,” pungkas Fadil.
Sebelum dilakukan pelaksanaan penyerahan Tersangka dan barang bukti (Tahap II), telah dilakukan pengecekan barang bukti (verifikasi) oleh Penyidik Bareskrim Polri kepada Jaksa Penuntut Umum Kejaksaan Republik Indonesia pada Selasa 04 Oktober 2022 bertempat di Kejaksaan Negeri Jakarta Selatan.
