BOGOR KOTA, (BS) – Pembangunan Masjid Imam Ahmad Bin Hanbal di Jalan Kolonel Ahmad Syam, RT 05/RW 10, Kelurahan Tanah Baru, Kecamatan Bogor Utara, Kota Bogor, mendapatkan penolakan dari beberapa warga sekitar dan intimidasi dari beberapa oknum dari pihak kecamatan.
Menanggapi hal itu, Pengacara dari pemborong ikut angkat bicara. Menurut Sharon Sandi, S.SH dirinya merasa aneh dengan adanya penolakan dari sebagian masyarakat tersebut.Pihaknya menyampaikan bahwa, posisi kliennya sudah benar.
Pasalnya, aturan untuk membangun rumah ibadah yaitu IMB sudah di kantongi. Anehnya lagi akibat penolakan itu pernah muncul gugatan dan itu pun sudah di menangkan dan sudah berkekuatan hukum tetap.
“Jadi memang terkait dengan pembangunan masjid ini kami telah memiliki IMB dan di kuatkan dengan keputusan dari Makamah Agung dengan nomor 310 K/TUN/2019 dimana di sana dikatakan bahwa pihak walikota berkewajiban melakukan sosialisasi terkait pembangunan masjid ini kepada warga sekitar, namun pada faktanya pembangunan masjid ini masih terbengkalai bahkan dari kontraktor juga tidak bisa melakukan pekerjaan,” katanya.
“Terkait dari oknum Kecamatan mereka bukannya membantu memberikan sosialisasi ini malah mencopot banner kita, saya pikir ini aneh kami yang benar dan seharusnya dilindungi, ini malah seakan-akan di intimidasi,” katanya.
Untuk itu pihaknya mendesak kepada Walikota untuk tunduk dan melaksanakan keputusan dari MA,karena menurutnya pemerintah Kota Bogor tidak memiliki alasan apapun untuk tetap menunda pembangunan rumah ibadah tersebut.
“Kalau boleh saya bacakan isi dari putusan MA adalah Mewajibkan kepada tergugat untuk mencabut surat keputusan Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Bogor Nomor 645.8/264-DPMPTSP Tahun 2018 tentang pencabutan keputusan kepala badan pelayanan perizinan terpadu dan penanaman modal kota Bogor nomor 645.8-1014-BPPTPM-IX/2016 tentang izin mendirikan bangunan masjid tertanggal 20 Maret 2018, jadi dengan kata lain bahwa disini walikota di anggap tidak tunduk dengan putusan MA karena apa sampai dengan hari ini pihak pemkot tidak melakukan apa yang sudah di putuskan oleh MA,”tegasnya.
Lebih lanjut Sharon mengatakan bahwa Negara kita adalah negara hukum dimana siapapun tanpa terkecuali harus tunduk terhadap hukum bukan malah sebaliknya.
“Ini yang saya bingung seharusnya Walikota tunduk terhadap Hukum karena putusan MA itu adalah produk hukum bukan malah tunduk terhadap segelintir masyarakat,” jelasnya.
Sementara itu Ketua salah satu ormas Benteng Bogor Raya (BBR) Razes Morgen bahwa pihaknya bersama dengan kesepuluh ormas lainnya bersepakat untuk mendukung pembangunan rumah ibadah yang mendapatkan penolakan dari segelintir masyarakat.
“Kami disini ingin berkumpul untuk memberikan dukungan karena kami anggap pendirian rumah ibadah merupakan hak setiap warga negara yang telah di atur oleh undang-undang,” jelasnya,senin(27/06/2022)
Tidak hanya itu pihaknya juga menekankan bahwa pendirian rumah ibadah tersebut telah mengantongi izin bahkan telah di menangkan di tingkat Makamah Agung (MA).
“Tidak ada alasan bagi masyarakat maupun pemerintah kota untuk menolak pembangunan masjid ini karena semua aturan sudah di tempuh dan sudah memiliki izin jadi mereka (pemerintah) seharusnya mendukung pendirian masjid ini,” tegasnya
